Gemini Apps Agentic Calling Additional Terms of Service

To use Agentic Calling in Gemini Apps (“Feature”), you must accept (1) the Google Terms of Service, (2) the Generative AI Prohibited Use Policy, and (3) these Gemini Apps Agentic Calling Additional Terms of Service (the “Additional Terms”). If a term isn't defined in these Additional Terms, it has the meaning given in the Google Terms of Service.

Please read these documents carefully. Together, these documents are known as the “Terms”. They establish what you can expect from us as you use our services, and what we expect from you.

We also encourage you to read our Privacy Policy to better understand how you can update, manage, export, and delete your information.

1. Feature Description

The Feature allows you to direct Gemini Apps to place outgoing telephone calls on your behalf, from your own phone number, to perform tasks such as making reservations, checking business hours, or obtaining information using an AI-generated voice.

2. Mandatory Disclosures & Identification

Your use of the Feature must comply with telecommunications laws and other global regulations. This includes the following requirements:

• AI Identification: At the start of every call, the Feature will automatically disclose that the recipient is speaking with a Google AI assistant on a recorded line. You may not attempt to disable, bypass, or obscure this disclosure.
• Caller Identification: You need to provide accurate identity and contact info so Gemini can accurately share it with the person you're calling.

3. Prohibited Use Cases

In addition to the prohibitions in the Google Terms of Service and Generative AI Prohibited Use Policy, you mustn't use the Feature to:

• Make non-personal calls. You can only use the Feature for personal reasons. Don't use it to make calls on behalf of a business, government agency, or law enforcement.
• Make emergency calls. The Feature doesn't support emergency calling. If you're in an emergency, call 911 or your local emergency number directly.
• Share health information. Don't use the Feature to transmit personal or sensitive health data (for example, with doctors’ offices or healthcare providers).
• Send spam, political messages, or telemarketing. You can't use the Feature to place bulk commercial calls, deliver political messages, or make unsolicited telemarketing calls.

4. Termination & Liability

Violation of these Terms may result in immediate suspension or termination of your access to Gemini Apps and other Google Products. To the extent allowed by applicable law, you’ll indemnify Google and its directors, officers, employees, and contractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of the Feature.

5. Limitations of AI

The AI assistant may occasionally misinterpret responses or provide inaccurate information during a call. Google doesn't guarantee that the Feature will successfully complete every task, and isn't responsible for outcomes resulting from AI errors.

6. Carrier Usage and Fees

When you direct Gemini to place a call, the Feature will place the call using your device's cellular network and your personal phone number. Standard minute usage and carrier rates apply. You're responsible for any fees, overages, or charges from your mobile carrier. Google isn't responsible for these telecommunications fees.
